BAJA 1000 FESTIVITIES BEGIN IN ENSENADA!

The world’s best desert racers began practicing Saturday, November 1st as official pre-running started for November's 41st Annual Tecate SCORE Baja 1000 desert race. With over 350 entries expected to compete in 28 Pro and 7 Sportsman classes for cars, trucks, motorcycles and ATVs, the most prestigious of all desert races will be held Nov. 19-23 in Ensenada, Mexico. Completing its 35th year as the World’s foremost desert racing sanctioning body, the event is the finale of the five race 2008 SCORE Desert Series. To date entries have come from 38 U.S. States and 19 countries. The Baja 1000 is the oldest and most well known of all desert races, and remains as the single most appealing accomplishment to a driver. Since 1967, the Granddaddy of all desert races has been run over the mysterious Baja California peninsula.

Because of the economics and logistics involved, past years have been an entire Baja peninsula run to La Paz or Cabo San Lucas, while other years it is a loop race, starting and finishing in Ensenada.The race will start for the 34th time and finish for the 19th time in Ensenada. The motorcycle and ATV classes will start at 6:30 a.m. (Friday, Nov. 21) with the car and truck classes starting at approximately 10:30 a.m., or three hours after the last ATV leaves the line. Vehicles will leave in 30-second intervals in the elapsed-time race. The fastest finishers are expected to complete the course in approximately 14 hours. All vehicles will have a 31-hour time limit to become official finishers in the legendary adventure.The race will start and finish on Boulevard Costero along the picturesque Bahia de Todos Santos in front of the historical Riviera del Pacifico Cultural Center in the heart of Ensenada.

CALIFORNIA CHANGES THE YACHT TAX EXEMPTION LAW

SAY ADIOS (AGAIN!)TO THE 90 DAY YACHT CLUB


Excerpts below from the October 2nd issue of the Log Newspaper.


California residents who purchase boats outside the state to avoid California sales tax will now have to keep them out-of-state longer, to qualify for a sales and use tax exemption. The bill Gov. Arnold Schwarzenegger signed on Sept. 30 immediately changed the former 90 day out-of-state stay requirement to 12 months to avoid use tax, which is equivalent to the state’s sales tax. The measure, Assembly Bill 1452, is one of number of budget bills passed by the California Legislature that make changes to state laws to implement revenue provisions of the 2008-09 Budget Act. The out-of-state waiting period reverted back to its original 90 days after Republican legislators, led by Sen. Dick Ackerman of Tustin, were instrumental in getting fellow lawmakers to remove a provision from California’s 2007-2008 budget that would have renewed the 12-month out-of-state requirement. As an “urgency measure,” AB 1452 took effect immediately after it was signed by the governor.


This year’s approach to the one-year requirement differs from the 2004 SB 1100 change in the law in two ways. First, the new law has no “sunset” provision, and the new rules are therefore theoretically “permanent.” Second, unlike the approach used in 2004, which provided a two-month phase-in period before the law became effective, this year’s modification to the law is effective immediately. In other words, if you are reading this and you have not signed a purchase contract, you will be subject to the one-year rule.


The highlights of the one-year rule provide that a buyer will be presumed to have purchased the boat in California, and thus be subject to assessment of sales or use tax, if:


• The buyer is a California resident and brings the boat into California within one year of purchase;
• The buyer is a nonresident and keeps the boat in California for more than six months during the first year after the purchase;
• The vessel is subject to the assessment of personal property tax at the county level (regardless of whether the buyer is a resident or a nonresident) during the first year after purchase.
The one significant exception to the one-year timetable allows an owner to keep the boat in California during a repair, retrofit or modification project without affecting the one-year analysis, as long as the boat logs less than 25 hours under way while it is in California.

   Dear Captain Lonnie,

            We have to thank you for getting us through what could have been a very difficult time. We purchased your “90 Day Yacht Club Guide to Ensenada” before we even bought our boat. Our questions were answered with regards to marina services and traveling around town as well as just basic local knowledge. You even addressed our “fear factor” issues and we enjoyed that chapter very much. Attitude begets attitude, this we found to be very important guidance and should be regarded as the “best advice ever given” when entering and traveling in Mexico. We’ve had our boat for seven months now and we make sure to keep your book in the car or on the yacht to visit points of interest (on land and water) and our favorite restaurants which we discovered through your book.

            We have found a smile and a little Spanish does go a long way here in Ensenada. Our advice to your potential book buyers, “you don’t have to own a boat to buy this guide!”

ENSENADA, THE SECOND MOST VISITED CRUISE SHIP PORT IN MEXICO

            Three new shipping lines recently decided to make Ensenada a stop on their itinerary. Currently Ensenada is second only to Cozumel on the Atlantic coast in the number of passenger delivered for an introduction to Mexican culture, carefree shopping, and revelry seeking. Over 500,000 visitors arrived in the year 2004, a historical record. The Princess, Holland America, and Celebrity lines have joined the Carnival and Caribbean cruisers that previously found Ensenada an attractive destination. 25 new-planed arrivals have been added to the passenger shipping schedule. This pushed the 2005 passenger count to over 1 million True Travelers dancing on the tables till the ship shoves off and whisks them out to sea at sunset for a slow cruise designed to give the passengers plenty of time to eat, drink, and gamble.

This performance of compliance with the State of California Law relieves the new owner's responsibility to pay the State sales tax on the purchase.
